Article I.: Protection Package
United Car Rental offers its customers various protection options to minimize financial risks associated with vehicle rental. Below are the available options, along with their corresponding daily charges and required deposits:
1. LRD – Lowering Risk Deductible
Includes:
Collision Damage Waiver (CDW): Coverage for physical damage to the vehicle due to collisions or rollovers.
Theft Protection: Coverage in case of theft or attempted theft of the vehicle.
Daily charge: USD 8.00
Required deposit: USD 350.00
2. MLRD – Lowering Risk Deductible ($200)
Includes:
Collision Damage Waiver (CDW).
Theft Protection.
Daily charge: USD 12.00
Required deposit: USD 200.00
3. TLRD – Lowering Risk Deductible ($100)
Includes:
Collision Damage Waiver (CDW).
Theft Protection.
Tire & Glass Coverage: Additional coverage for tire and glass damage.
Daily charge: USD 20.00
Required deposit: USD 100.00
4. ZRD – Lowering Risk Deductible ($0)
Includes:
Collision Damage Waiver* (CDW).
Theft Protection*.
Tire & Glass Coverage*.
Daily charge: USD 25.00
Required deposit: USD 0.00
5. Default Option (No Package Selected)
If the customer does not select any of the above options, the following mandatory basic coverage will automatically apply:

Collision Damage Waiver (CDW).
Theft Protection.
Required deposit: USD 500.00
The Collision Damage Waiver (CDW) and Theft Protection do not cover damages caused by gross negligence, driving under the influence of alcohol or drugs, use of the vehicle outside permitted terms, or intentional damage.
The Tire & Glass Coverage is only available in the TLRD and ZRD packages.
All deposits will be held on the credit card provided at the time of vehicle pickup and will be refunded at the end of the rental period, provided there are no additional charges for damages or breaches.
The customer must select their preferred protection option before signing the rental agreement. If no option is selected during the reservation process, the mandatory basic coverage with a deposit of USD 500.00 will automatically apply.
Article II. Rental Period Regulations.
Renter will use the Rented Vehicle only for personal or routine business use and operate the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all applicable laws relating to holding of licensure to operate the vehicle and pertaining to operation of motor vehicles. Renter will not sublease the Rental Vehicle or use it as a Vehicle for hire.
Renter must provide to Owner with proof of insurance that would cover damage to the Rental Vehicle the time this Car Rental Agreement is signed as well as personal injury to the Renter passengers in the Rented Vehicle, and other persons or property. If the Rental Vehicle is damaged or destroyed while it in the possession of Renter, Renter agrees to pay any required insurance deductible and also assign all rights to collect insurance proceeds to Owner.
Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal actions against Owner as a result of Renter’s operation or use of the Rented Vehicle during the term of this Car Rental Agreement. This includes any attorney fees necessarily incurred for these purposes.
Renter will also pay for any parking tickets, moving violations, or other citations received while in possession of the Rented Vehicle.
If driver’s license has already expired or will expire in the period the vehicle will be rented, it is strictly prohibited to rent the vehicle.
It is mandatory to write down the Email address and phone number of the client in case of an emergency the car rental has to be able to contact the client.
Article III. Vehicle Rental Regulations
Ad 3.1 Clients must rent the vehicle for a minimum of 3 days. If the rental period is only 1 or 2 days, an additional charge of $10 per day will apply. Failure to enforce this charge will result in the $10 fee being charged to the employee responsible.
The vehicle comes with basic insurance coverage. In the event of an accident, if the incident is NOT caused by the client, the insurance will cover all damages. However, if the accident is caused by the client, the client will be responsible for paying all associated damages.
Article IV. Curaçao Residents Regulations
Ad 4.1 The Local renter is responsible for accidents by which he/she commits and is at fault, is forced to sign an agreement with the Insurance Company of United Car Rental B.V.
Contact United Car Rental right away after an accident takes place in less than 24 hours period. Further instructions will be given by the employee from United Car Rental. In case of charges for damages done by the renter to the Rented Car that has not been paid in full by the renter, the Car Rental will contact the Collection Agency-Incasso Bureau-in Curaçao. The costs from any legal dispute or charges not paid in full are to the Renter’s Account. Late Fee from 2% is applied on each overdue date by not paying in time. It is mandatory to write down the Email address and phone number of the client in case of an emergency the car rental must be able to contact the client.
Article V. AFTER OFFICE HOURS
(i) Ad 5.1 Airport Location:
Will allow returns after hours and will have procedures in place for your early or late return. Please check with rental location when picking up your rental vehicle for exact procedure and the location of the drop box.
(ii) Ad 5.2 Non-Airport Location:
You may not return the car after office hours.
In both cases if you drop off a car at a closed location, your responsibility for damage to or loss of the car will continue – and all charges stated on the rental document will continue until the return location reopens and we retake actual possession of the car and the car keys.
(iii) Ad 5.3 DRIVERS.
The renter needs to be at least 24 years of age and at least 1 year in the possession of a Dutch or international valid driver’s license. Copies will NOT be accepted! Renters of 23 and 24 years of age can rents a car, but a surcharge of US$ 10,00 (Naf. 17,50) per person per day will apply witha deductible of US$ 500,00 (Naf. 875,00).
(iv) Ad 5.4 ADDITIONAL DRIVERS.
The charge for an “additional divers” is US$ 8.00 (Naf. 14.00) per person per day and conditions are the same as for the renter, at least 25 years of age and 1 year in the possession of diver’s license. Only the renter and the authorized “additional drivers”, which are mentioned and specified on the rental agreement, are authorized to drive the car. In case of any accident and the driver is not mentioned as renter or “additional driver” on the contact, the insurance protection is voided, and the renter is responsible for the full value of the damage.
(v) Ad. 5.5 FUEL.
The vehicle is delivered with a certain amount of fuel. This as also the minimum amount that the vehicle should be returned with. Is this amount is less, we will charge the difference on the contract. This charge will be higher than the normal rates at the gas station. No refunds on fuel are made! Please check in advance if your rental vehicle is using gasoline or diesel! In case the wrong fuel is tanked in the vehicle, the repair cost, towing cost, refueling or any other damage done to the vehicle due to the wrong fuel will be charged to the renter.
(vi) Ad 5.6 VALUABLES IN THE VEHICLE.
We advise you not to leave any valuables in the vehicle. If you are forced to leave anything, place this in the trunk. UNITED CAR RENT can NOT be held responsible for any loss and/or theft of valuables from the vehicle. When you leave the vehicle unattended, it should be locked at all times (windows, doors, and trunk), this will prevent theft. All our vehicles are provided with an Alarm System and/or immobilizer. There is a mandatory security charge of US$ 2.86 (Naf. 5.00) per rental.
Article VI. ACCIDENT / JOYRIDING OR THEFT
(i) Ad 6.1 ACCIDENT / DAMAGE
IN CASE OF AN ACCIDENT EVEN IF THERE ISN’T ANOTHER PARTY INVOLVED CALL FORENSYS / CRS IMMEDIATELY AT (+5999) 199, THE INSURANCE COMPANIES REQUIRE A FORENSYS / CRS ACCIDENT REPORT!
Follow this process is crucial:
In case of an accident or collision, renter must act as follows:
Inform the letter immediately and call the Curacao Road Service: 9233.
If necessary, warn the traffic police: 911.
Before arrival of the ‘Curacao Road Service’ the vehicle may NOT be moved. After arrival of the ‘Curacao Road Service’ the vehicle may only be moved with their permission.
Follow the instructions of the letter, like submitting a testimony and/or other documents which relate to the incident.
Renter must always, within 24 hours (unless otherwise agreed in writing) fill out, sign and hand a claim form of the ‘Curacao Road Service’ to letter.
Renter must abstain of admission of guilt, in whatever form.
Never leave the vehicle without properly activating all available safety precautions against accidents, theft and burglary.
All possible assistance to defend claims by third parties or to get compensation by third parties must be rendered to letter and any other persons appointed by letter. Besides, renter must assist in all documents/letters etc. renter/driver receives regarding the accident and hand these documents/letters etc. to letter.
If above mentioned instructions are not observed, letter is not entitled to compensation by insurer; the entire damage will be recovered from the renter.
In case of an ‘hit and run’ call an employee from United Car Rental immediately!
IF THE FORENSYS / CRS AGENT IS NOT NOTIFIED IMMEDIATELY, THE INSURANCE PROTECTION IS VOIDED AND YOU WILL BE RESPONSIBLE FOR THE FULL VALUE OF THE DAMAGE. RECONSTRUCTION REPORTS WILL NOT BE ACCEPTED.
In case the rental vehicle has damage you also need to call the 24-7 Roadside assistance at: (+5999) 9247 (+5999) 4650896. If the vehicle cannot be repaired on the spot, the 24-7 Roadside assistance will tow the rental vehicle. You will be brought to your next destination or one of our to rental location. Depending on the accident and availability of cars you can receive a replacement vehicle. In all cases a new authorization will be done for the deposit. All cost of towing the vehicle will be for the renter. All charges will be charged on the contract. In case of damage or defects on the vehicle, the renter is not allowed to use the vehicle in case this could lead to aggravation of the damage and/or defects and/or eventual consequence damage and/or decrease of road safety of the car. In case of damage or defects on the vehicle, the renter is not allowed to use the
vehicle in case this could lead to aggravation of the damage.
A damage report must be made and signed within 24 hours after the damage by UNITED CAR RENT, Phone: (+5999) 696 8866 / (+5999) 690 1050 • Willemstad. Also, the vehicle must be viewed by the claims department of UNITED CAR RENT.
Article VII. Car Maintenance Regulations
(i) Ad 7.1 Commitment
Renter declares, subject to proof of the contrary, to have received the vehicle without any visible defects and/or damages, unless otherwise stated in the damage registration.
In case of a defect to the vehicle / interior and/or damage to or caused by the rental car, renter is entitled to inform letter immediately.
Renter declares not to overload the vehicle with passengers, luggage etc.
You must fill the car with BENZINE. When you return the car it must have the same fuel content as it had when you received the car. Difference per 1/8 tank costs usd. 25 –usd. 175 (empty, 1/8, 1/4, 3/8, 1/2, 5/8, 3/4, 7/8, full).
The renter is responsible for ensuring that the vehicle is refueled with the correct type of fuel as specified in the rental agreement (e.g., gasoline/benzine and not diesel). In the event that the wrong fuel type is used, the renter will bear all associated costs. If the error is limited to cleaning the fuel tank to rectify the issue, the renter will be responsible for covering the cleaning expenses. However, if the incorrect fuel damages the engine or other components, the renter will be liable for all repair costs, which will be determined based on a formal quotation from an authorized mechanic.
It is not allowed to park the car at Hato airport at night. Parking at the Waaigat, in Otrabanda and Punda after 06:00 pm is at own risk. Watamula, Shete Boca and beaches with unguarded parking lot is at you own risk. In case of theft and damage all costs will be recovered from the renter.
In case of damage and broken windows and, thus, loss of rental days for the benefit repair, renter is not entitled to alternative transport. In case of damage to the car, for which the deposit is used, deposit remains in trust of the letter until damage has been paid.
Renter is fully liable for damage caused by neglecting warning lights and temperature meters on the dashboard and damage caused intentionally, conditional intent or with approval of letter. It is not allowed to carry out (or have carried out) modifications and repairs without approval of letter.
In case renter leaves the car unattended, renter must remove the key and lock the car and activate the theft security. In case of breakdown or damage you must contact the letter as soon as possible. If you fix a defect to your car yourself, it cannot be charged.
If investigation shows damage exceeds deposit, an additional claim will take place.
Do not leave anything in the car. It avoids damage to car and theft of your belongings.
In case renter takes to another accommodation or private residence, other than where renter stays or not, the car always needs to be parked in a guarded parking area.
It is NOT allowed to park the car in the street or outside a guarded parking area.
The vehicle may not be used or navigated:
By a person who does not have a valid driving license, whose name and address are not mentioned on the rental agreement, or by a person whose name, address or age have not been registered correctly.
By a person who is under influence of alcohol or drugs, or by a person who suffers from any physical or mental problem, affecting his/her ability to navigate a vehicle, affecting his/her attentiveness.
For transport of passengers or goods at compensation, for the benefit of a purpose contrary against the law (like theft, smuggling etc.) for speed tests, for driving lessons, for matches or rally is or to push along or drag another vehicle or trailer.
(ii) Ad 7.2. JOYRIDING OR THEFT.
In case of Joyriding or theft you are required to call and notify the police department immediately, telephone 911 and give an official declaration. You will receive an official police rapport. The damage and service department needs to receive a copy of the official police report that same day.
If this is in the weekend you can hand it over to a rental agent at one of our rental locations.
IN CASE YOU CAN NOT PROVIDE US WITH A POLICE REPORT, YOU WILL BE HELD RESPONSIBLE THE FULL COSTS OF THE DAMAGE, CAUSED TO THE VEHICLE. YOU ALSO NEED TO NOTIFY UNITED CAR RENT IMMEDIATELY.
(iii) Ad 7.3 FLAT TIRE.
Renter is responsible for checking water- and oil level and tire pressure. Costs for possible damage caused by negligence will be recovered from renter. A flat tire and damage to tires are at renter’s account. For this, renter can visit a ‘tire-repair-shop’. Changing and repairing a tire or replacing a tire – in case the tire cannot be repaired – must be arranged and paid by renter. Renter must immediately inform letter in case tires have been repaired. If the vehicle is returned with a flat (spare) tire, Nafl 350 will be charged.
Each vehicle is provided with a spare tire and the necessary tools. In case of a flat tire you can call the 24-7 Roadside assistance at (+5999) 9247 (+5999) 4650896. They will pump the tire and/or replace it with your spare. The renter is responsible for replacing this broken tire and also for the costs of repairing the flat tire. You can do this at a “tire service” or through the 24-7 Roadside assistance. This charge will be higher than the normal rates at a “tire service.”
(iv) Ad 7.4 CAR KEYS.
In case of a “lock out” or lost keys, contact the 24-7 Roadside assistance at: (+5999) 9247 (+5999) 4650896. In case the loss of keys, the entire deposit of US$ 500,00 / Naf. 875,00 may be charged. The charge for the lost key depends entirely on the vehicle type. In case of a “lock out” the charge will be US$ 50,00 / Naf. 87,50. In case of a “lock out” or lost keys all cost will be for the renter and will be charged on the rental agreement.
Car keys cannot be given to anyone else these can only be given to authorized drivers on the rental agreement, United employees or employees of 24-7 Roadside assistance. In case of non-compliance with these conditions, the insurance protection, also if CDW is accepted. Is voided and you will be responsible for the full value of the damage or loss resulting of this non-compliance.
If the client loses or damages the car key, a fee will be charged to the responsible for the key, starting at $250,= depending on what the agency charges the owner.
(v) Ad 7.5 CLEANING COSTS.
Additional cleaning charges will be charged to the renter if the vehicle is returned excessively dirty, with stains or in case it’s wet on the inside. All charges will be charged to your rental agreement. Minimum costs US$ 125.00. The car must be returned in the same state, inclusive of accessories, spare tire, and tools. The car must be cleaned prior to return (both inside and outside). Cleaning costs might be charged (Nafl 50) if letter considers it necessary. The car is insured for use on public roads. Damage and pollution caused by off-road use are always completely at renter’s account; at least the entire deposit will be withhold.
(vi) Ad 7.6 NO SMOKING.
It’s not allowed to smoke in our vehicles. Additional cleaning charges will be charged to the renter if the vehicle is returned smelling like there have been smoked in the vehicle. All charges will be charged to your rental agreement. Minimum costs US$ 200.00.
(vii) Ad 7.7 Prohibited Activities and Penalties.
The renter agrees not to engage in any illegal or inappropriate activities while using the rented vehicle. This includes, but is not limited to, the use of any type of drugs inside the vehicle or engaging in sexual activities within the car. Violation of this clause may result in a penalty fee of up to $1,000 USD. Additionally, if the circumstances warrant, United Car Rental Curaçao reserves the right to report the incident to the local authorities in Curaçao for further legal action.
(viii) Ad 7.8 Alternative Transport
Renter is, if continue driving the vehicle turns out to be impossible, because of a defect, only entitled to alternative transport if the rental company has another car available. Other costs or (consequential) loss will not be compensated. In all other cases in which continue driving is impossible, renter is not entitled to alternative transport. The renter is entitled to alternative transport (if available), if renter is not declared guilty of a collision.
(vix) Ad 7.9 REFUNDS.
Please note that (partially) unused vouchers and gas is NON reimbursable! Even if you hand in the vehicle earlier than agreed, we don’t issue a refund.
Article VIII. Termination Regulations
Ad 8.1 United Car Rental is entitled to cancel the rental agreement immediately, without proof of default or judicial intervention, without prejudice to his right to compensation of costs, damage and interest, if
it turns out that renter hasn’t (completely) met (in time) the rental conditions during the rental period;
in case of death, being in receivership,
application for a moratorium or bankruptcy petition; or if circumstances occur during the rental period of which letter was not informed at the start of the rental period, which would not have led to a rental agreement if letter would have known these circumstances.
Possible nullity or invalidity of one or more of above-mentioned conditions do not influence the validity and application of the other conditions. Possible costs because of not observing these conditions are completely at renter’s account.
Article IX. Regulations by unfulfillment of Payment from Damages
Ad 9.1 In case of charges for damages done by the renter to the Rented Car have not been paid in full by the renter, the Car Rental will contact the Collection Agency (Incasso Bureau) in Curaçao. The costs from any legal dispute or charges not paid in full are to the Renter’s Account. Late Fee from 2% is applied on each overdue date by not paying in time.
Ad 9.2. The Curacao legislation is applicable to this Rental Agreement and its conditions.
Conflicts which result from these conditions and/or rights and obligations of persons involved to which these conditions apply, will exclusively be settled by the authorized judge in Willemstad (Curacao) and, in urgent cases, by the President of the Court in Willemstad. Curacao, seen and approved by Renter.
